1. Purpose
These General Terms and Conditions of Sale govern the relationship between Be Kind (hereinafter “the Studio”) and its clients (hereinafter “the Client”) for Pilates classes, related services, and the use of the facilities.
These T&Cs cover bookings, memberships, and purchases made via the Bsport platform (website or app). By confirming a purchase or booking, the Client accepts all provisions herein.
2. Registration and Payment
1. Bookings, memberships, and class credit purchases are made via Bsport in the Client’s name. A personal, non-transferable account is required. The Client is responsible for the accuracy of their information and for managing their payment methods in Bsport. Confirmations, changes, and cancellations are notified by Bsport (email, app). The Client must ensure they receive these notifications.
3. Prices for classes, packs, and memberships are shown on the website or at the Studio. The Studio may change prices with 30 days’ notice.
4. Payments are processed by the payment providers integrated in Bsport. Prices are in CHF, VAT included where applicable.
3. Validity of packs and memberships
1. Single class: Valid for 1 month from purchase.
2. 10-class pack: Valid for 4 months.
3. 20-class pack: Valid for 6 months.
4. 50-class pack (BeKinder): Valid for 12 months.
5. The validity of promotional packs offered from time to time is specified during the purchase process.
After expiry, unused credits are permanently forfeited. No extension is due.
4. Cancellation and Rescheduling of Classes
1. Any cancellation must be made at least 12 hours before the class. The credit(s) will then be re-credited to your Bsport account and can be reused for another booking.
2. In case of late cancellation by you or no-show, the credit for the class is lost and will not be re-credited to your Bsport account.
3. The Studio may cancel or reschedule a class if an instructor is unavailable or in cases of force majeure. Classes with fewer than two registrations are generally cancelled. Credits used for classes cancelled by the Studio will be re-credited to the registered Clients’ Bsport accounts. The expiry date of these credits remains based on the purchase date in accordance with clause 3 Validity of packs and memberships. No cash refunds or re-credit to the original payment method.
5. Extension of pack validity for medical reasons
1. In the event of a sudden inability to practice Pilates for health reasons, the client may request an exceptional suspension of their pack of sessions/single classes. This request must be accompanied by an official medical certificate explicitly stating the prohibition on practicing Pilates.
6. Gift cards and promotional codes
Gift cards and promo codes are subject to a validity date indicated in Bsport. Not cumulative unless stated otherwise. Not exchangeable for cash.
7. Health and liability
1. The Client declares they are in good physical and mental health and fit to practice Pilates.
2. Any medical condition or restriction must be reported to the Studio before the class begins.
3. The Studio accepts no liability for accidents or injuries occurring during classes, except in cases of proven gross negligence.
4. The Client must follow instructors’ guidance and use the equipment appropriately.
8. Use of the facilities
1. The Client undertakes to respect the premises, equipment, and other clients.
2. Any intentional damage will be charged to the Client.
3. Personal belongings remain the Client’s responsibility. The Studio declines all liability in case of loss or theft. The Studio declines all liability in case of loss or theft.
9. Data privacy
1. The Client’s personal data are collected solely to manage registrations and communications related to classes.
2. These data will not be sold or shared with third parties without the Client’s consent.
10. Code of conduct
1. Punctuality is mandatory. The Studio reserves the right to refuse entry in case of late arrival.
2. Clothing suitable for Pilates is required.
11. Changes to the T&C’s
The Studio reserves the right to amend these T&Cs. Any change will be communicated by email or posted at the Studio.
12. Governing law
These T&Cs are governed by Swiss law. In the event of a dispute, the competent courts are those of the canton of Valais.
By registering at the Studio, the Client declares that they have read, understood, and accepted the T&Cs by signing the document.
By registering online, the Client declares that they have read, understood, and accepted the T&Cs by ticking the relevant checkbox in the form.
